Virginia Supreme Court strikes down Democratic gerrymandering poll

The Virginia Supreme Court ruled rightly and boldly on Friday that a Democrat-backed gerrymandering referendum violates the Virginia Constitution. The decision ensured that Virginia, a state that Republicans lost by only about 5 percent in 2024, would retain its 6-5 Democrat-Republican map, compared to a 10-1 Democratic-Democrat map. The left went crazy over the decision. Since then, Virginia has appealed this decision to the United States Supreme Court. The unusual showing from the Democrats leading up to the decision is sad but instructive: If they can regain power nationally, the rest of the country will become what Virginia has become.
Gov. Abigail Spanberger ran as “mid.” In his brief campaign, he shied away from the left-wing proposals of New York City Mayor Zohran Mamdani, focusing instead on kitchen-table issues like affordability. When he took office, Spanberger exposed himself, quickly ending Virginia's cooperation with ICE. Leftist legislators began introducing proposals to authorize the prosecution of ICE agents, a sign of rebellion against the legitimate assertions of federal authorities. Spanberger endorsed the state Legislature's hard-left agenda—which included a slew of new tax increases and pro-crime policies—and promoted it by supporting Virginia's crackdown efforts, along with former President Barack Obama, who has criticized crackdowns.

The Left has tried to redistrict by suing for decades in states it couldn't argue otherwise. Alabama, Texas, and Louisiana have all had cases before the Supreme Court in recent years to enforce illegal and unconstitutional racial discrimination that has produced some of the least competent DEI Congressmen in the history of our Republic.
Leftists have spent more than $60 million on the Virginia poll effort. The problem was that early voting began before the legislature voted to send the referendum to voters. Under the Virginia Constitution, two separate convention votes must take place before submitting a referendum for the electors to approve or disapprove, with an election in between. Democrats argued that early voting took place before the election even though early voting was ongoing in the election that Spanberger ultimately won.

Many have warned that the plan is unconstitutional, including former Virginia Attorney General Jason Miyares. The serious and misguided Democrats didn't listen. The judge of the court decided to continue the referendum, but Jay Jones, the leftist attorney general – who once supported the killing of children of his political opponents – argued that the Supreme Court of Virginia could not rule on the validity of the referendum until it was completed, that is, after the voters went to the polls. The Supreme Court agreed and allowed the survey to proceed as Jones had requested.

The referendum narrowly passed, and the Supreme Court then heard arguments about its constitutionality. In a 4-3 decision by Justice D. Arthur Kelsey, who was appointed to the Court of Appeals by then-Gov. Mark Warner, a Democrat, the Supreme Court overturned the referendum. The takeaway was clear: Legislatures can redraw maps, even gerrymander, but gerrymanders cannot be based on race, and must be drawn according to state law and the constitution.

Leftists lost their minds after the Supreme Court decision. Jones blasted the decision as political — speech blocked by a man who dreamed of putting bullets in the heads of Virginia House Speaker Todd Gilbert's children. Sen. Tim Kaine criticized the decision, arguing that the Supreme Court should have ruled before the referendum, noting that the justices did exactly what Jones asked: let the referendum go ahead, then rule on its validity. Some leftists online urged Spanberger to ignore the court. A very unreasonable proposition, however, would destroy a Virginia judge.

Michigan State University law professor Quinn Yeargain suggested the legislature lower the retirement age for judges to 54, the youngest justice age for most. Then the entire court would have to retire, the left-wing legislature could choose a completely new bench, new judges would try the case again, and a referendum would be passed. Another version of this myth involves challenging the legality of Virginia's independent redistricting commission that was approved by voters in 2020.

Thankfully, Virginia Democrats are sensible enough to put their foot down to stop this madness. One has accurately labeled the program “schizo hopium.” Although this misguided plan failed, it is still instructive. Imagine if the Democrats achieved the trifecta: the House, the Senate, and the White House. They are relentlessly insulting the US Supreme Court and will no doubt continue when the justices refuse to overturn Jones's absurd decision on the Virginia Supreme Court decision.

Leftists are desperate to fill the US Supreme Court, adding at least four more justices. Virginia backed off the cliff that many disaffected Democrats wanted to jump off, for now. If the radical Democrats take power as they did in 2021, they will not hesitate to jump off that rock and take the whole nation with them.
